Esta página explica cómo eliminar los datos personales tratados por MARUBASA TECH S.L. (CIF B88765094, C/ Zurbano 45, 1º 28010 Madrid, España) a través de Sermima, ¡Hola! y los canales de mensajería asociados, incluido WhatsApp.
Puedes hacerlo tú mismo desde la aplicación, sin escribirnos y sin esperar. Si prefieres pedirlo por correo, también explicamos cómo.
1. Si usas la app ¡Hola! (pacientes y clientes)
Eliminar toda tu cuenta
Abre la app y entra en Perfil → Eliminar cuenta → Eliminar definitivamente. Son tres toques.
Se borran tus datos, tus citas y tu historial en todos los negocios con los que tengas relación a través de ¡Hola!, junto con los identificadores de notificación de tus dispositivos. La eliminación es inmediata y no se puede deshacer.
Eliminar tu relación con un solo negocio
En la pantalla de inicio, dentro de Mis negocios, desliza el negocio y pulsa Quitar. Se elimina tu relación con ese negocio y tus citas con él; el resto de tu cuenta y los demás negocios no se tocan.
2. Si eres cliente de un negocio y no usas la app
Los datos que un negocio guarda sobre ti (su ficha de cliente, sus citas, su historial) son responsabilidad de ese negocio: Sermima actúa como encargado del tratamiento. La vía más rápida es pedírselo directamente a él, que puede ejecutarlo en su panel al instante.
Si prefieres no dirigirte al negocio, o no consigues respuesta, escríbenos a privacidad@sermima.com y trasladamos la solicitud al responsable, acompañándola hasta que se resuelva.
3. Si eres un negocio suscrito a Sermima
Para borrar los datos de uno de tus clientes: entra en Clientes, abre su ficha y pulsa Borrar (RGPD). La eliminación es inmediata y queda registrada en tu registro de auditoría, como exige el principio de responsabilidad proactiva.
Para eliminar la cuenta completa del negocio, incluidos todos los datos de tus clientes, escríbenos desde la dirección de correo del titular a privacidad@sermima.com. Cancelar la suscripción no borra los datos por sí solo: queremos una instrucción explícita antes de destruir el historial de un negocio.
4. Qué se elimina
- La ficha de cliente y sus datos de contacto.
- Las conversaciones y todos los mensajes intercambiados, en cualquier canal: chat web, ¡Hola!, WhatsApp, SMS y correo.
- Las citas y su historial.
- Los archivos asociados: fotografías de citas, documentos y grabaciones de voz, borrados también del almacenamiento de objetos donde residen.
- Los identificadores de notificaciones push de tus dispositivos.
- Las incidencias de conocimiento generadas por tus conversaciones con el asistente.
5. Qué se conserva, y por qué
El derecho de supresión (art. 17 RGPD) tiene un límite: no alcanza a los datos que otra ley nos obliga a conservar (art. 17.3.b). Preferimos decirlo aquí antes que sorprenderte después. Son tres casos, y ninguno más.
- Facturas. La cadena de facturación es inalterable por diseño y la normativa fiscal obliga a conservarla. La factura permanece con sus datos fiscales, pero se rompe su vínculo con tu ficha y con tus citas.
- Pagos. El rastro económico se conserva por la misma razón, sin su vínculo con la cita.
- Historia clínica. Cuando el negocio es un centro sanitario, el art. 17.1 de la Ley 41/2002 le obliga a conservar la documentación clínica durante un plazo mínimo contado desde cada episodio asistencial. Durante ese plazo, las notas clínicas, sus revisiones, los consentimientos y los documentos se conservan íntegros: una historia clínica anonimizada deja de ser una historia clínica, así que aquí no cabe la solución que sí aplicamos a una factura. Tu ficha sobrevive reducida a la identidad mínima que ese registro necesita y queda marcada como tratamiento limitado (art. 18 RGPD): deja de usarse para cualquier otra cosa. Todo lo demás se borra igual, y el resto se borra al cumplirse el plazo.
Cuando eliminas tu cuenta desde la app, la propia app te dice si algún negocio ha tenido que retener algo por esta vía.
6. Plazos
Las eliminaciones que ejecutas tú desde la app o desde el panel son inmediatas. Las solicitudes por correo se resuelven en el plazo máximo de un mes desde su recepción (art. 12.3 RGPD); si la solicitud fuera especialmente compleja te informaremos de la prórroga y de sus motivos.
7. Solicitarlo por correo electrónico
Escribe a privacidad@sermima.com con el asunto Supresión de datos e indica el número de teléfono o el correo electrónico con el que te comunicaste con el negocio, y el nombre del negocio si lo recuerdas. Podremos pedirte que acredites tu identidad, únicamente cuando tengamos dudas razonables sobre quién realiza la solicitud (art. 12.6 RGPD).
8. Reclamación
Si consideras que no hemos atendido correctamente tu solicitud, puedes reclamar ante la Agencia Española de Protección de Datos (aepd.es). Agradecemos, en todo caso, la oportunidad de resolverlo antes.

You can do it yourself in the app, without writing to us and without waiting. If you would rather ask by email, that route is described too.
1. If you use the ¡Hola! app (patients and clients)
Delete your whole account
Open the app and go to Profile → Delete account → Delete permanently. Three taps.
This erases your data, appointments and history at everybusiness you have a relationship with through ¡Hola!, along with your devices' push notification identifiers. Deletion is immediate and cannot be undone.
Delete your relationship with a single business
On the home screen, under My businesses, swipe the business and tap Remove. Your relationship with that business and your appointments with it are erased; the rest of your account and the other businesses are untouched.
2. If you are a client of a business and don't use the app
The data a business holds about you - its client record, its appointments, its history - is that business's responsibility: Sermima acts as its data processor. The fastest route is to ask the business directly, since it can carry out the erasure from its dashboard immediately.
If you would rather not approach the business, or you get no answer, write to privacidad@sermima.com and we will pass the request to the controller and follow it through until it is resolved.
3. If you are a business subscribed to Sermima
To erase one of your clients: open Clients, open their record and press Erase (GDPR). Deletion is immediate and is written to your audit log, as accountability requires.
To delete the entire business account, including all of your clients' data, write to us from the account owner's email address at privacidad@sermima.com. Cancelling a subscription does not by itself delete the data: we want an explicit instruction before destroying a business's history.
4. What is deleted
- The client record and its contact details.
- Conversations and every message exchanged, on any channel: web chat, ¡Hola!, WhatsApp, SMS and email.
- Appointments and their history.
- Associated files - appointment photos, documents and voice recordings - deleted from the object storage that holds them as well.
- Your devices' push notification identifiers.
- Knowledge gaps generated by your conversations with the assistant.
5. What is retained, and why
The right to erasure (GDPR art. 17) has a limit: it does not reach data another law obliges us to keep (art. 17(3)(b)). We would rather say so here than surprise you later. There are three cases, and no others.
- Invoices. The invoicing chain is append-only by design and tax law requires it to be kept. The invoice survives with its fiscal fields, but its links to your record and your appointments are severed.
- Payments. The financial trail is kept for the same reason, without its link to the appointment.
- Clinical records. Where the business is a healthcare provider, art. 17.1 of Spanish Law 41/2002 obliges it to keep clinical documentation for a minimum period running from each episode of care. During that period the clinical notes, their revisions, consents and documents are kept intact: an anonymised clinical record is no longer a clinical record, so the approach we take with an invoice is not available here. Your record survives reduced to the minimum identity that documentation needs, and is flagged as restricted processing (GDPR art. 18) - it stops being used for anything else. Everything else is erased as normal, and the remainder is erased once the period expires.
When you delete your account from the app, the app itself tells you whether any business had to retain something on these grounds.
6. Timescales
Deletions you carry out yourself, in the app or in the dashboard, are immediate. Requests by email are resolved within one month of receipt (GDPR art. 12.3); should a request be unusually complex we will tell you about the extension and why it was needed.
7. Requesting deletion by email
Write to privacidad@sermima.com with the subject Data deletion and tell us the phone number or email address you used to communicate with the business, and the name of the business if you remember it. We may ask you to confirm your identity, but only where we have reasonable doubts as to who is making the request (GDPR art. 12.6).
8. Complaints
If you believe we have not handled your request properly, you may lodge a complaint with the Spanish Data Protection Agency (aepd.es) or with the supervisory authority of your country of residence. We would, of course, appreciate the chance to put it right first.
